THIS REFUND POLICY APPLIES ONLY IF YOUR ACCESS TO SQILLS (THE "SERVICE") HAS BEEN PURCHASED DIRECTLY ON THE WEBSITE AVAILABLE VIA WWW.SQILLS.AI, INCLUDING ALL SUBDOMAINS (THE "WEBSITE").
WHERE PAYMENTS ARE PROCESSED BY PAYMENT PROCESSORS, THE TERMS AND CONDITIONS OF THE RELEVANT PAYMENT PROCESSOR SHALL APPLY, AND THIS REFUND POLICY SHALL BE INTENDED TO SUPPLEMENT (BUT NOT OVERRIDE) SUCH TERMS AND CONDITIONS AND ANY MANDATORY CONSUMER LAW.
By using the Service on any computer, mobile phone, tablet, or another device (collectively the "Device"), you as a user of the Service confirm that you have read, understand and agree to be bound by this Refund Policy and any other applicable law.
We may change this Refund Policy at any time without notice, effective upon its posting on the Website. Your continued use of the Service shall be considered your acceptance of the revised Refund Policy. If you do not agree to this Refund Policy, please do not use this Service.
We may update this Refund Policy from time to time. Unless required by law, changes will apply only to future purchases. The version in effect at the time of your purchase will apply to that purchase.
1. Payment Methods
Through the Website, you may purchase access to the paid Content (as defined in the Terms of Use) of the Service ("Purchase") using any of the following payment methods:
- Bank Card: you can make a Purchase simply and securely using your bank card, e.g. Mastercard or Visa at link. Your bank card information will be encrypted at the point of transaction. Not all bank cards may be acceptable for purchase.
- PayPal: you can make a Purchase simply and securely via our Website, opting for the PayPal payment method during checkout.
- Apple Pay: you can make a Purchase simply and securely via our Website, opting for the Apple Pay payment method during checkout.
The cost of the Purchase (either one-time payment or subscription payment) is provided within the Service on the relevant checkout screen.
2. Access and Payment Processing
You will be granted access to the Content immediately after your payment (either one-time payment or subscription payment) is confirmed by the payment processor (merchant of record) and provisioning is completed.
Please note that to process the payment we use third-party services (i.e. payment processors). Such services enable the transaction initiated by you and notify us of its completion. We do not store or collect your payment details ourselves. This information is provided directly to our third-party payment processors.
3. Finality of Purchases
You agree that the Purchase is final, except where required by applicable law and/or where refunds are permitted under this Refund Policy or under the policies of the payment processors mentioned above.
4. Refund Eligibility — Technical Issues
Notwithstanding the foregoing, you may be eligible to receive a refund of a one-time payment or last subscription payment if you have experienced technical issues with your Purchase within 14 (fourteen) calendar days starting from the Purchase date and have requested a refund during the same 14 (fourteen) days from the date of Purchase (where the Purchase date shall be understood as the date of validation of your payment by our servers for a one-time payment or as the date of validation of your last subscription payment by our servers) and, as a result, your use of the Purchase is rendered impossible.
If technical problems prevent or unreasonably delay the delivery or provisioning of access to the Service, the remedy may be (i) restoration or replacement of access, or (ii) a full or partial refund, as determined by the payment processor where applicable. To assess the issue, we may request device details, reproduction steps, and screenshots or screen recordings.
The technical issues may include material crashes, failure to launch, non-clickability of buttons, and other issues, which render your use of the Purchase impossible.
5. Information We May Request
To understand whether you are eligible for a refund, we may ask you to provide the following information:
- your device's model, operating system, and version;
- the steps you are taking when this issue appears;
- a screen video or screenshots that would illustrate the issue;
- any additional information that would help us identify the problem, if the details you have already provided are not enough to identify the issue you're experiencing.
6. Money-back Guarantee and General Conditions
We value any feedback and do everything to make our customers happy with our products and services. However, if you are not completely satisfied with our services, you can get a refund according to the terms provided herein.
Generally, if you do not meet the conditions of our Money-back Guarantee set out above, the fees you have paid are non-refundable and/or non-exchangeable, unless otherwise is stated herein or as required by applicable law. In addition, certain refund requests may be considered by our company on a case-by-case basis and granted at our sole discretion.
A refund can usually be claimed only during the subscription period. If the subscription period has expired before you made a request for a refund, we will not be able to provide you with a refund.
7. How Refunds Are Issued
Refunds (if approved) are issued to the original payment method by the payment processor. We may coordinate the request on your behalf, but we do not directly process card or bank refunds where the payment processor is used.
8. Note for US Residents (California and Connecticut)
If you reside in California or Connecticut and cancel the purchase at any time prior to midnight of the third business day after the date of such purchase, we will return the payment you have made.
9. Note for EU Residents
If you are a consumer based in the EEA or Switzerland, you have an automatic legal right to withdraw from contracts for purchases of Services. However, when you make a purchase of a single item of digital content (such as a video recording or a pdf file) you expressly agree that such content is made available to you immediately and you, therefore, lose your right of withdrawal and will not be eligible for a refund. By signing up for our Service which is not a single item of digital content and is provided on a continuous basis (such as subscriptions to the App) you expressly request and consent to an immediate supply of such Service. Therefore, if you exercise your right of withdrawal we will deduct from your refund an amount that is in proportion to the Service provided before you communicated to us your withdrawal from the contract.
10. Right of Withdrawal
Exercise of the Right of Withdrawal. Where you have not lost your right of withdrawal, the withdrawal period will expire 14 days after the day you enter into that contract. To exercise your right of withdrawal, you must inform us Soul Stretch LTD. via email billing@sqills.ai of your decision to withdraw from a contract by an unequivocal statement (e.g. a letter sent by post or e-mail). To meet the withdrawal deadline, you need to send your communication to us saying you wish to withdraw from the contract before the withdrawal period has expired.
11. Payment Method Discretion
Where there is a legitimate reason, we reserve the right for each Purchase to refrain from offering certain payment methods and to specify alternative payment methods.
